These Terms of Service ("Terms") govern your access to and use of ebrochure.app, our products (including Welka), and any related services (collectively, the "Services") provided by Out Thinking Electronics Private Limited ("we", "us", "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our Services. By using our Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. Acceptable use

You agree not to:

4. Subscription and payment

• Be responsible for all taxes associated with your subscription, except those based on our income

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel anytime through your account settings.

5. Refunds

Subscription fees are generally non-refundable. We may issue refunds at our discretion, particularly in cases of service disruption or error. Pro-rated refunds may be considered for plan downgrades within the first 7 days of upgrade.

6. Intellectual property

All content and materials on our Services, including software, text, graphics, logos, and trademarks, are the property of Out Thinking Electronics Private Limited or our licensors, protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of content you upload or create using our Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely for the purpose of providing the Services to you.

7. Service availability

We strive to provide reliable Services but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice when feasible. We are not liable for any modification, suspension, or discontinuation.

8. AI-generated content

Some of our Services use artificial intelligence to generate responses, content, and recommendations. While we strive for accuracy, AI-generated outputs may contain errors. You are responsible for reviewing and verifying AI-generated content before relying on it for business decisions.

9. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Out Thinking Electronics Private Limited and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination will do so.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

15. Changes to terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the modified Terms.
